These terms govern use of the ontrais.ai website and the Ontrais pilot workspace operated by Ontrais Proprietary Limited ("Ontrais", "we"). By using the website or a pilot workspace, you agree to them. Workspace access is provided under a pilot arrangement with your organisation; where a signed pilot agreement exists, it takes precedence over these terms.

The service

Ontrais provides workflow software that helps organisations organise data-protection compliance work — processing registers, breach response records, deadlines, readiness assessments, documents, and reports — structured with reference to Botswana's Data Protection Act 2024. Access is by application and is currently limited to a controlled pilot.

Not legal advice; human-owned decisions

Ontrais is a support tool, not a law firm or a regulator. Nothing in the platform — including guidance produced with AI assistance — is legal advice, and no output determines a legal obligation. Regulatory determinations, including whether a breach is notifiable, remain the responsibility of your organisation's named decision-makers, who should take qualified legal advice where required. AI-assisted outputs are provided for review by a human user and are recorded in the workspace audit trail.

Accounts and acceptable use

Workspace access is for authorised users of the participating organisation. Sign-in links are personal: do not share them or let others use your session. You agree not to misuse the service — including attempting to access another organisation's data, probing or disrupting the platform, or using it for unlawful purposes. We may suspend access that puts the service or other customers at risk.

Your organisation's records

Your organisation owns the records it enters into its workspace. You grant Ontrais the rights needed to host and process those records solely to provide and support the service. Your organisation is responsible for the lawfulness and accuracy of the data it enters, including having a proper basis to record any personal data. Our handling of personal data is described in the Privacy Notice.

Pilot status and availability

The platform is at pilot stage and is provided "as is" and "as available". Features may change, and we do not promise uninterrupted availability. We work to keep the service reliable and to give reasonable notice of material changes, and pilot access carries no charge unless separately agreed in writing.

Intellectual property

Ontrais retains all rights in the platform, its design, and its documentation. These terms do not transfer any Ontrais intellectual property to you, and no rights are granted except as needed to use the service during the pilot.

Confidentiality

Each side will treat the other's non-public information with reasonable care: we will not disclose your workspace records except as needed to provide the service or as required by law, and you agree not to disclose non-public information about the platform.

Liability

To the maximum extent permitted by law, Ontrais is not liable for indirect or consequential loss, loss of profits, or regulatory penalties arising from use of a pilot service, and our total liability in connection with the pilot is limited to the amounts (if any) paid for it. Nothing in these terms excludes liability that cannot lawfully be excluded.

Ending access

Either side may end pilot participation on reasonable notice. On exit, we will make your organisation's records available for export for a reasonable period and then delete them in line with the Privacy Notice.

Governing law

These terms are governed by the laws of the Republic of Botswana, and the courts of Botswana have jurisdiction over any dispute arising from them.
